Terms of Service

These Terms of Service ("Terms") govern your use of the games, websites, and related services (the "Service") provided by Giroshima Games ("Giroshima," "we," "our," or "us"). By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy (collectively, the "Agreement"). If you do not agree, do not use the Service.

Arbitration & Class Action Waiver: Except where prohibited by law, disputes must be resolved by individual arbitration and not by jury trial or class action. See Dispute Resolution below.

1. Eligibility & Accounts

1.1 Minimum Age. You represent that you are of legal age to form a binding contract or have parental/guardian consent.

1.2 Account Creation. You may need an account to use certain features. Provide accurate information and keep your credentials secure. You are responsible for all activity under your account.

1.3 Suspension/Termination. We may suspend or terminate access for suspected violations of these Terms, illegal activity, or to protect the Service or users.

2. License & Use of the Service

2.1 Limited License. Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use.

3. Virtual Items & Purchases

3.1 Virtual Content. The Service may offer virtual currency, virtual goods, passes, season content, or subscriptions (collectively, "Virtual Items"). Virtual Items have no real-world monetary value and are licensed, not sold.

3.2 All Sales Final. Purchases are final and non-refundable to the fullest extent permitted by law. Platform terms (e.g., App Store, Google Play) may apply to billing, refunds, and chargebacks.

3.3 Price/Availability. We may change pricing, availability, or features of Virtual Items at any time.

4. User Content

4.1 Your Content. You retain ownership of content you submit ("User Content"). You grant Giroshima a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, distribute, and display your User Content in connection with the Service and our business (including for promotion), subject to our Privacy Policy.

4.2 Responsibility. You are solely responsible for your User Content and for obtaining necessary rights to submit it.

4.3 Monitoring. We may, but are not obligated to, monitor or remove User Content that violates these Terms.

5. Intellectual Property

5.1 Ownership. The Service, including all software, artwork, assets, trademarks, and content, is owned or licensed by Giroshima and protected by law.

5.2 Feedback. If you provide feedback, you grant us a perpetual, irrevocable license to use it without obligation to you.

The Service may link to or rely on third-party services (analytics, ad networks, platform SDKs). We are not responsible for third-party services or their content, terms, or policies.

8. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION OR THAT DEFECTS WILL BE CORRECTED.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GIROSHIMA AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND PARTNERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR LOSS OF DATA, PROFITS, OR REVENUE, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 6 MONTHS BEFORE THE CLAIM OR (B) USD $50.

10. Indemnity

You agree to indemnify and hold Giroshima harmless from claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your User Content, or your breach of these Terms.

11. Dispute Resolution; Arbitration; Class Waiver

11.1 Informal Resolution. Contact us first to try to resolve any dispute at giroshimagames@gmail.com.

11.2 Binding Arbitration. Except where prohibited by law, any dispute arising out of or relating to these Terms or the Service shall be resolved by final and binding arbitration on an individual basis.

11.3 No Class Actions. You and Giroshima agree that each may bring claims only in your or its individual capacity, and not as a plaintiff or class member in any class or representative proceeding.

11.4 Venue & Rules. Unless required otherwise by local consumer law, arbitration will be administered by a reputable arbitration provider under its rules. If arbitration is not enforceable in your jurisdiction as to a particular claim, the claim shall proceed in the courts identified in Governing Law below.

12. Governing Law & Jurisdiction

These Terms are governed by the laws of your country of residence if mandatory consumer protections apply; otherwise, they are governed by the laws of Türkiye, without regard to conflict of laws. Subject to arbitration, courts located in Ankara, Türkiye have exclusive jurisdiction.

13. Term & Termination

We may suspend or terminate access to the Service at any time for any reason, including if you breach these Terms. Upon termination, the license granted to you ends and you must cease use of the Service. Sections that by their nature should survive (e.g., IP, disclaimers, liability limits, dispute resolution) will survive termination.

14. Changes to the Terms

We may update these Terms from time to time. Material changes will be effective on posting or as otherwise stated. Your continued use of the Service after changes become effective constitutes acceptance.
